Terms of Service and Privacy Notice

Version 2026-09-02. Effective September 2, 2026. Personakind is operated by Potions and Familiars LLC, a Missouri limited liability company ("we", "us"). Plain words on purpose: if a sentence here reads two ways, the plainer reading is the one we mean.
The short version. Personakind lets you build AI personas and publish them. Personas are AI, not people, and every published page says so. We collect your email, what you choose to put in your personas and profile, and a ledger of paid messages. We never see your card. Hosted chat sends your messages to an AI provider to get a reply and we do not keep the transcript. If we ever have a breach that touches your data, we tell you.

1. Terms of Service

1.1 Who can use it

You must be at least 18 years old. By creating an account, buying anything, or ticking the agreement box, you accept these terms and the privacy notice below. If you do not agree, do not use the service.

1.2 What the service is

Personakind is a tool for writing "personas": grids of plain-text cells that describe how an AI should think and talk. You can keep a persona private, publish it on a public page, chat with it using your own API key, or chat with it through our hosted chat by buying messages. Personas can carry an image and a voice you choose. The service is provided "as is", without warranty of any kind, to the extent the law allows.

1.3 Your content

You own what you write. By publishing a persona you give us a worldwide, non-exclusive, royalty-free licence to store it, display it on its public page, serve it to readers and to AI models on your behalf, and show it in Explore, until you unpublish or delete it. Private personas are shown only to you and to people you have explicitly allowed to operate your account. You are responsible for what your personas say and contain. Do not publish personas that impersonate a real person without that person's consent, that contain someone else's private information, that are unlawful, or that are hate speech. We may remove content and suspend accounts that break these rules, and readers can report any public persona.

1.4 AI output

Replies from a persona are generated by an AI model from the cells you or another author wrote. They can be wrong, made up, or unlike what the author intended. They are not advice of any kind. Do not rely on them for medical, legal, financial or safety decisions. Every public persona page carries an AI disclosure, and you must not remove it.

1.5 Paid messages, credits and limits

Hosted chat is sold as a pack of messages ("credits") on a monthly or yearly plan through RevenueCat and Stripe. One reply normally costs one message; a very large persona costs two or three and the chat drawer says so before you send. A generated persona image costs 15 messages. Hearing a reply in a Gemini voice costs 2 to 6 messages depending on length. Free features (chat on your own key, image upload, the browser voice) cost nothing. Limits, stated so nobody is surprised: 10 generated images and 200 voiced replies per day per account; unused messages expire when the plan period ends and renewal resets the balance to the pack; when the site reaches its monthly capacity, hosted chat and image creation pause and your messages stay yours until they expire. A failed call is refunded automatically. Payments are handled by Stripe under RevenueCat's checkout; we never see or store your card number. Plans renew until cancelled and you can cancel any time from the receipt email or by contacting us; refunds for time already used are at our discretion, and refunds required by law are always given.

1.6 Your own API key

If you paste your own Anthropic API key, it is stored only in your browser's local storage and sent from your browser directly to Anthropic. It never reaches our servers. You are responsible for that key and its charges.

1.7 Accounts and handles

A handle (@name) is permanent once claimed and cannot be changed. Reserved words and impersonating names are refused. You may delete your personas and your account at any time; see the privacy notice for what deletion covers.

1.8 Liability

To the fullest extent the law allows, our total liability to you for any claim arising from the service is limited to the amount you paid us in the twelve months before the claim, and we are not liable for indirect, incidental or consequential loss. Nothing here limits liability that cannot be limited by law.

1.9 Changes, law, disputes

We may change these terms; the version and date at the top change when we do, and material changes are announced on the site before they apply. These terms are governed by the laws of the State of Missouri, and disputes are heard in the state or federal courts for Buchanan County, Missouri, unless the law where you live gives you a right to something else.

We do not run advertising, we do not sell your data, and we do not use your private personas or your chat messages to train anything.

2.2 Who processes it

Supabase (database, authentication, file storage), Cloudflare (hosting and the API), Anthropic (hosted chat replies), Google (persona images and voices), RevenueCat and Stripe (subscriptions and payments), and GitHub (the public source code and a static mirror of the site, which carries no user data). Each processes data under its own terms and privacy policy. Your card details go to Stripe only.

2.3 Public by choice

A persona is private until you mark it public. A public persona, your handle, display name, bio and the image on a public persona are visible to anyone on the internet and to AI clients that read the public Personakind connector. Unpublishing removes a persona from the public pages, but copies others already made are outside our control.

2.4 Your rights

You can read, edit, export (the persona editor downloads the grid as a file) and delete your personas and profile at any time from the site. To delete your whole account, or to ask what we hold about you, email us; we answer within 30 days and delete within 30 days of a verified request, except records we must keep for tax or payment law (purchase records, kept for the period the law requires). If you live somewhere with a data-protection law that gives you more rights than this page (for example the GDPR or a US state privacy law), you have those rights too.

2.5 Cookies and local storage

We use no advertising or tracking cookies. The site keeps in your browser only what it needs to work: your sign-in session, your own API key if you chose to add one, and small preferences such as which tutorial you dismissed.

2.6 Children

The service is for adults. We do not knowingly collect data from anyone under 18; if you believe a minor has an account, email us and we will remove it.

3. Security and what happens if there is a breach

Every table is protected by row-level security at the database, so one account cannot read another's private data even if the site's own code fails. Secrets never ship in the page. Payments never touch our servers. We keep the amount of personal data small on purpose.

If we learn of unauthorised access to personal data we hold, we will: contain it; notify every affected person by the email on their account without unreasonable delay and within the time the law requires (Missouri law, RSMo 407.1500, and the law of the state or country where you live); say what was taken, when, and what we did about it; and notify the authorities where the law requires. No agreement can waive those duties and we do not ask you to.
